Tree Removal and Pruning Regulations for the City of Newcastle Council
When approval is required:
- If the tree that is being removed is more than 3 meters (measured at breast height, 1.4m) from the footing of a dwelling (with a floor area of over 20m2), unless the tree is listed on the Tree Exemption Species List
- If the tree that is being removed is part of a Heritage-Listed property or within a Heritage Conservation Area; in this case a Minor Works Heritage Notification is also required.
- If the tree being removed is within a native vegetation community, wetland, riparian zone, or endangered ecological community; a Native Vegetation Removal Permit must be submitted.

Application Requirements:
- A report from an AQF Level 5 arborist is required, assessing the tree’s health, structure and associated risks.
- The arborist report must meet the criteria outlined in Part A, Section 3.4.4 Urban Forest Technical Manual.

- If you are removing a tree as part of a DA or CDC, you must obtain an arborist report and include it within your DA or CDC. Any private tree removal applications will be denied if it is for development.

Pruning Guidelines
- Pruning is permitted for up to 10% of the live canopy only.
- Removal of deadwood is allowed.
- All pruning work must comply with Australian Standards AS4373-2007 – Pruning of Amenity Trees.
- Branch Management will not top your trees, we will only prune back to where it has been previously pruned.

Bushfire Prone Areas
- Under the NSW Rural Fire Service 10/50 Vegetation Clearing Scheme, property owners in designated bushfire-prone areas may remove certain trees within 10 meters of a home without council permission. You can check if this applies to your property here.
